YOUNG FARMERS BIG GAME ESSAY CONTEST OFFICIAL RULES
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR ODDS OF WINNING.
Eligibility: The contest is open to current or perspective CHS Inc. co-op members, who are legal residents of the United States (excluding residents of New York and Florida and who are eighteen (18) years of age or older. Employees of Sponsor and their immediate family members are prohibited from entering. Entrants are subject to all applicable federal, state and local laws and regulations. Void where prohibited by law.
Sponsor: The contest is sponsored by CHS Inc., 5500 Cenex Drive, Inver Grove Heights, MN 55077 (“Sponsor”).
Agreement to Official Rules: By participating in this contest (the “Contest”), entrants agree to abide by the terms and conditions thereof as established by Sponsor. Sponsor reserves the right to qualify all submissions and to reject any submissions that do not meet the requirements for participation as established by Sponsor.
Contest Period: The Contest begins on June 1, 2017 and ends on September 15, 2017 (“Contest Period”). Entries received before or after the Contest Period are void. Sponsor’s computer is the official time-keeping device for the Contest.
How to Enter: During the Contest Period, go to www.chsBigGame.com and submit either (1) a written essay of 250 words or less or (2) a video of 2 minutes or less on one of the following topics:
- Tell us how your relationship with your cooperative(s) makes your farm or ranch stronger for the future.
- What does the “cooperative spirit” mean to you and your family, and why is it important to the future of your operation?
- Explain how your cooperative is essential to your community.
- What would you like your cooperative(s) to do in order to better serve your needs and those of future generations?
There is a limit of one entry per person regardless of the method of entry.
Sponsor assumes no responsibility for computer system, hardware, software or program malfunctions or other errors, failures, delayed computer transactions or network connections that are human or technical in nature, or for damaged, lost, late, illegible or misdirected entries; technical, hardware, software, electronic or telephone failures of any kind; lost or unavailable network connections; fraudulent, incomplete, garbled or delayed computer transmissions whether caused by Sponsor, the users, or by any of the equipment or programming associated with or utilized in this Contest; or by any technical or human error that may occur in the processing of submissions or downloading, that may limit, delay or prevent an entrant’s ability to participate in the Contest.
Sponsor reserves the right, in its sole discretion, to cancel or suspend this Contest and award the prizes from entries received up to the time of termination or suspension should causes beyond Sponsor’s control, including unauthorized human intervention, which, in the sole opinion of Sponsor, corrupt, compromise or materially affect the administration, fairness, security or proper play of the Contest or proper submission of entries. Sponsor is not liable for any loss, injury or damage caused, whether directly or indirectly, in whole or in part, from downloading data or otherwise participating in this Contest.
Selection of Winners: On or about October 2, 2017, up to eight (8) winners will be selected by a panel of judges based on the following criteria: 75% on depth of thought and quality of insights shared on selected topic and 25% on a demonstration of connection with production agriculture and the cooperative system. The odds of winning are not calculable in advance and depend on the number of eligible entries received.
Notification of Potential Prize Winners: The Prize Winners will be notified via email and/or telephone within five (5) business days of the judges’ final decisions. If any Prize Winner does not acknowledge acceptance of the Prize within ten (10) business days after being notified that he or she is a Prize Winner, another Prize Winner may be chosen using the same procedure specified above.
Requirements of Prize Winners: Sponsor may require all Prize Winners to sign and return an affidavit of eligibility and liability and publicity release, wherever lawful, as a precondition to award of any Prize. If any Prize Winner fails to sign and return the requested documents to Sponsor, that Prize Winner may be disqualified, and the Prize will thereafter be awarded to an alternate Prize Winner from the remaining valid entries using the procedure specified above.
Prize: Each Prize Winner will receive two (2) tickets to the 2018 Super Bowl game in Minneapolis, Minnesota on February 4, 2018; two (2) tickets to NFL Live valid February 1-4, 2018; two (2) tickets to Taste of the NFL on February 3, 2018; round-trip coach class airfare for the Prize Winner and his or her travelling companion from an airport within the 48 contiguous United States reasonably close to the Prize Winner’s city of residence to Minneapolis and four (4) nights in one (1) standard room at the Sheraton Minneapolis West, with check in on February 1, 2018 and check out on February 5, 2018. Prizes are non-transferable and can only be claimed and used by Prize Winners. No portion of the prize may be resold or redistributed. The estimated retail value of each Prize is within the range of $8,000 USD and the total ARV of all Prizes is within the range of $64,000 USD. Taxes, if any, are the sole responsibility of each Prize Winner. All travel arrangements will be made by Sponsor, whose decisions regarding the itinerary are final. Selection of airline and airport shall be at the discretion of Sponsor or its designee. Each Prize Winner is solely responsible for satisfying all legally required conditions of travel. Each Prize Winner and his or her travel companion must have valid travel documents (e.g., government issued identification, parental consents to travel) prior to departure, and failure to do so may result in forfeiture of all or some aspects of the Prize. Sponsor is not liable for any expenses incurred as a consequence of flight cancellation or delay or any weather or airline issues that prevent any Prize Winner and his or her travel companion from traveling, in which event any missed portion of the Prize is forfeited in its entirety and no substitution will be provided. All expenses not specified above, including, but not limited to ground transportation, baggage fees, meals, beverages, gratuities, incidentals and taxes are the sole responsibility of each Prize Winner. Final actual value may vary. Any unused portion of the Prize is not transferable or exchangeable and cannot be redeemed as cash. Sponsor reserves the right to substitute a different Prize of approximately equivalent value in its sole discretion.
RELEASE AND PUBLICITY: ENTRANTS AGREE TO RELEASE AND HOLD HARMLESS SPONSOR AND ITS RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, PARTNERS, AFFILIATED COMPANIES, SUBSIDIARIES, SUPPLIERS, DISTRIBUTORS, ADVERTISING AND PROMOTIONAL AGENCIES, AGENTS, SUCCESSORS AND ASSIGNS FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF PARTICIPATION IN THE CONTEST. SPONSOR IS NOT RESPONSIBLE FOR ANY TYPOGRAPHICAL OR OTHER ERROR IN THE PRINTING OF THE OFFER OR ADMINISTRATION OF THE CONTEST OR IN THE ANNOUNCEMENT OF THE PRIZE. By receipt of the Prize and by signing an affidavit of eligibility and liability/publicity release, if requested, each Winner consents to the use of his or her name, and address by Sponsor for advertising and promotional purposes, without any additional compensation, except where prohibited. No entries will be returned. All entries become the property of Sponsor.
DISPUTES: EACH ENTRANT AGREES THAT: (1) ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR IN CONNECTION WITH THIS CONTEST, OR ANY PRIZES AWARDED, SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORTING TO ANY FORM OF CLASS ACTION, PURSUANT TO ARBITRATION CONDUCTED UNDER THE COMMERCIAL ARBITRATION RULES OF THE AMERICAN ARBITRATION ASSOCIATION, TO TAKE PLACE IN Minneapolis, MINNESOTA; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS CONTEST, BUT IN NO EVENT ATTORNEYS' FEES; AND (3) UNDER NO CIRCUMSTANCES WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, AND CONSEQUENTIAL DAMAGES, AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES, OR THE RIGHTS AND OBLIGATIONS OF ENTRANT AND SPONSOR IN CONNECTION WITH THE CONTEST, SHALL BE GOVERNED BY, AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF MINNESOTA, WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW, RULES OR PROVISIONS (WHETHER OF THE STATE OF MINNESOTA OR ANY OTHER JURISDICTION) THAT WOULD CAUSE THE APPLICATION OF THE LAWS OF ANY JURISDICTION OTHER THAN THE STATE OF MINNESOTA.
